Ghana Property Power of Attorney From Abroad: An Evidence Checklist
Separate representative evidence, service requirements, identity records and legal boundaries.
Giving someone access to a property file is not the same as proving what that person is authorised to do. For an owner managing Ghana property from abroad, keep the task, document, property reference, identity evidence and official response connected.
Short answer: The Lands Commission Client Service Charter says that when an applicant is represented by another person, a stamped Power of Attorney must accompany the required documents. It also states that notarisation applies where the Power of Attorney was executed outside Ghana. This is a document requirement, not a conclusion that a representative has authority to sell, mortgage, register or otherwise deal with a property. Official Lands Commission charter
Questions to ask first
- What exact task is the representative being asked to perform?
- Does the authority cover this property, document and transaction?
- Has the document been prepared and witnessed as the relevant authority requires?
- What identity and supporting records must accompany the application?
- How will the owner receive dated evidence of each step?
1. Define the task before appointing anyone
A request to obtain a certified copy is different from a request to submit a registration document. A request to collect a document is different from authority to negotiate or sign. Write down the property reference, document, authority requested, limits, reporting route and end date for the assignment.
S.E.S does not draft, validate or recommend a Power of Attorney. A Ghana-qualified lawyer or the relevant authority must answer questions about wording, authority, execution, revocation and legal effect.
2. Match the document to the Lands Commission record
The Lands Commission certified-true-copy page says an application may be signed by the property owner or an authorised representative with a Power of Attorney. It also lists a valid photo ID and, for certified plotted documents, an approved site plan and police extract.
Use the relevant service page as the starting point. Record the document title, parties, property location, plot or instrument reference and the exact service requested. Do not assume that a document used for one service satisfies another service.
3. Record stamping and overseas execution questions
The Lands Commission Client Service Charter says a stamped Power of Attorney must accompany required documents where an applicant is represented by another, and that notarisation applies where the Power of Attorney was executed outside Ghana. The source does not turn this into one universal format for every transaction.
Record where the document was executed, what stamping or notarisation evidence is present, who witnessed it and which office has confirmed the submission route. Do not rely on a scanned signature or forwarded image as proof that an authority accepted the document.
4. Keep identity and supporting documents together
The Lands Commission title-registration guidance lists names and addresses of parties, signatures, witnesses, an approved plan and supporting or recited documents among the information used for registration. Keep copies of the Power of Attorney, identity records, property documents, plans, applications, receipts, correspondence and authority responses in one dated register.
Avoid sending unnecessary identity documents through informal channels. Use the official submission route and keep a record of who received each document.
5. Separate representation from title and specialist decisions
A Power of Attorney is not automatically a title certificate, registered interest, boundary confirmation, permit, lease approval, tax clearance or payment confirmation. A representative’s report is not the same as an official record.
S.E.S does not provide legal, land-registration, surveying, tax, financial, planning or title-certification services. S.E.S does not certify the validity, scope, execution, notarisation, stamping, revocation or legal effect of a Power of Attorney, and does not certify title, boundaries, permits, leases, tax liability or payments. Confirm specialist questions with the Lands Commission, relevant Ghana mission or notary, and a Ghana-qualified lawyer.
Pause before relying on the authority
Pause if the task is vague, the property reference is missing, the document is only a forwarded image, execution evidence is unclear or a representative’s report is presented as proof of title or official acceptance.
Keep representative evidence clear from abroad.
S.E.S can organise supplied evidence and dated observations within an agreed oversight scope. An enquiry is not Power of Attorney, legal, land-registration or title advice.
